Knox County PBA Violates the Knox County Code

This exclusive story from WVLT Volunteer TV (CBS) caught the attention of Brian's Blog. It appears that the Public Building Authority PBA are not being good neighbors in Hardin Valley. Jeff Galyon, employee of the PBA dismisses the disruption due to a tight time line to complete the construction of the new High School.

The bottom line is that the workers and vehicles are working at 4:00 a.m. A violation of the Knox County Code dealing with Noise. They are pouring concrete at 4:00 a.m. as well.

Knox County Code Article III. deals with NOISE. Sec. 26-66 outline what Excessive noise are prohibited. Sec. 26-67 outline Prohibited acts enumerated. The following subsection's read as follows

(4) Operation of vehicles. The use of any automobile, motorcycle or other vehicle so out of repair or loaded in such a manner as to create loud and unnecessary grating, grinding, rattling or other noise or the extended operation or refrigerated trucks or trailers between the hours of 10:00 p.m. and 7:00 a.m. the following day or any time on weekends or holidays, such that the sound therefrom creates a noise disturbance across the residential real property boundary, except by a variance approved by the board of zoning appeals.

(8) Loading and unloading. Loading, unloading, closing or other handling of boxes, crates, containers, building materials, garbage cans or dumpsters, motor vehicles or similar objects between the hours of 10:00 p.m. and 7:00 a.m. the following day or anytime on weekends or holidays, such that the sound therefrom creates a noise disturbance across a residential real property boundary, except by a variance approved by the board of zoning appeals.
